UPDATE:

The Claim Form deadline has passed and no further claims are being accepted.  If you submitted a Valid Claim Form, a Notice of Determination will be mailed to you by November 19, 2014.

The Notice of Determination will advise you whether or not you qualify as a Class Member and the amount of your Settlement Class Payment, if any.  If you are entitled to a payment, a check will be included with the Notice of Determination.  The Notice of Determination will include instructions regarding what to do if you want to object to the determination.

If you believe the determination is incorrect, you may object by submitting a written Objection. Any Objection you submit should provide all reasons and facts supporting your assertion that the determination is incorrect.  The Objection may not contain any documentation or information not previously submitted with your Claim Form.  Any Objection you decide to submit must be postmarked on or before January 19, 2015, and mailed to the Farmers Settlement Administrator at the following address:

If your Objection is not resolved between Class Counsel and Farmers, Class Counsel may elect to submit the Objection to a neutral third party Referee.  The Referee's decision shall be final and binding.

IF FARMERS INSURANCE EXCHANGE OR CERTAIN OTHER INSURANCE COMPANIES SUBTRACTED A DEDUCTIBLE FROM A PAYMENT MADE TO YOU ON A PROPERTY INSURANCE CLAIM, A CLASS ACTION LAWSUIT MAY AFFECT YOUR RIGHTS

You may be eligible for a payment as a potential Settlement Class Member under the proposed class action settlement (the “Settlement”) if:

o    You suffered a loss on or after March 16, 2007;

o   Your loss was covered under a property insurance policy with Farmers Insurance  Exchange or another insurance company involved in this Settlement;

o   You received an insurance payment on your property insurance claim and the claim was closed by the insurance company on or before March 31, 2013;

o   A deductible (or portion thereof) was subtracted from the insurance payment;

o   The amount of at least one category of your covered loss exceeded an applicable coverage limit in your policy; and

o   You otherwise qualify as a Settlement Class Member and timely submit a Valid Claim Form.

Your legal rights are affected whether you act or do not act.  Please read the notice you recevied carefully.

Your Legal Rights And Options In The Settlement

Submit a Valid Claim Form

If you qualify and the Court grants “final approval” to the proposed Settlement, you will receive a payment.

Ask to be Excluded

Get no payment.  The only option that allows you to sue Farmers Insurance Exchange and other related insurance companies or people, over the claims resolved by the Settlement.

Object

Write to the Court about why you don’t agree with the proposed Settlement.

Go to a Hearing

Ask to speak in Court about the proposed Settlement if you have previously filed with the Court, and served on the parties, a valid written objection to the Settlement before the court hearing.

Do Nothing

You will not be eligible for payment and will not be able to sue Farmers Insurance Exchange and other related insurance companies or people over the claims resolved by this Settlement.
